Legal Issues
1. Obscene publications act
It is illegal to publish content that may negatively influence readers.
Obscene means inappropriate for the general public. This includes things such as: pornography, nudity, graphic violence, drug abuse. The act makes sure that any media you make is safe/appropriate to show to the target audience. It also includes content that coerces and manipulates its audience into doing something.
My target audience:
My audience's age group is 60+ this is because the majority of this age group will be retired and or out to retire and will therefore have more time for gardening, walks and nature in general. My audience's social class would be ABC1 this is because they would need plenty of disposable income for binoculars, cameras, books on wildlife and nature and to have a Wildlife Trust/RSPB membership. My audience's gender isn't specified because in my experience and through articles/stories in other magazines there is around an even split of gender.
My safety concerns are:
1) Showing wildlife killing/eating other wildlife as there will be younger people reading my magazine as well and this could scare them.
2) Making people aware not to go onto private land when bird/animal/plant/fungi spotting due to trespassing and being arrested. On top of this animal owners and private land owners will have barbed wire and electrical fences and if they hunt animals there will be animal traps to watch out for whilst walking as well as shooting zones.
3) Treat wildlife with respect especially around deer, foxes, badgers, hunting dogs, and livestock and horses. They are unpredictable and can be dangerous if cornered, or threatened and can carry tetnis, rabies, and even TB.
2. Libel law
Libel is where people release false information about people and brands. This is written word such as in a paper, book, newspaper or magazine. Information should not damage reputations and images of people and brands. To prevent this back-up information with facts, figures and statistics from my official websites. Mine will be the official Wildlife Trust website, RSPCA website and RSPB website.
I will adhere to this based on my genre by:
Genre - I will adhere to libel law by making sure I follow the codes and conventions of my genre by looking at other nature and wildlife magazines and seeing how they look.
Articles - I will adhere to libel law by making sure I back up my articles and opinions with clear facts and statistics and sight the sources so that people know where my information comes from.
Representations - I will adhere to libel law by creating positive representations of my magazines genre and its audience when writing my articles, creating how it looks and choosing my models.
3. Copyright
Copyright is making sure intellectual property from its owner isn't used without their explicit permission first. Copyright is designed to protect the original expression of a concept and the form of a creative work, but doesn't protect the concept itself. Copyright law is subject to many limitations which is based on public interest, an example would be the United State's fair use doctrine. For copyright, make it clear/ adda sentence stating how you will adhere to copyright by taking your own photos too. Include two things you will photograph and how this will fit your genre
I will adhere to copyright by:
Finding what brand (s) are relative to my magazine and its genre. Then when sourcing them and their logo(s) making sure that I have their written consent through a consent form.
Sourcing my information in my articles/ getting permission to use them.
Sourcing the creators of vectors and brushes I use in my design and creation of my magazine/ getting permission to use them.
I will also adhere to copyright by taking my own photos for the magazine. This fits my genre because it is a Nature and Wildlife magazine but the issue is all about Photography, to show natural progression in real photography is positive for readers to see.
4. Laws of contempt
It is illegal to report on a current or ongoing caught legal case that is happening in my magazine. You can report on the facts but you cannot give or report on an opinion. Especially a personal opinion. You are allowed to source someone else's opinion however you must name them and source it as a direct quote as well as possibly needing to gain their permission to use their words.
It is a criminal offence to publish content that poses a risk to justice proceedings. Prevent magazines from publishing anything that is too sensationalist about a criminal case. Thinking of my magazine as a brand I need to make sure that laws of contempt are met online as well.
Examples of plausible court cases to my genre:
1) Trespassing - If hikers, ramblers, and wildlife enthusiasts trespass on private owned land such as a farm. As well as this they could also damage crops, startle livestock and even damage fences and property when walking where they shouldn't.
2) Poaching/hunting - If people who hunt/fish/forage either purposefully or accidentally damage, frighten or hunt endangered or protected species in the UK and are caught by the necessary authorities.
Ethical Issues - means it is more to do with morals and how you represent people.
What ethical issues could come up in my magazine?
1) Treatment of crew members and models. They should have at least a 30 minute rest break if they work for more than 4 hours and 30 minutes in a day. It is important to give crew members sufficient break/down time in order to boost morale and favour of the production. It is also in the best interest
2) Biased ideas and opinions displayed throughout magazine.
3) Crediting work and information that I use in my magazine.
